At Archer Education, Inc. (“Archer Education”, “Archer”, “we”, “us” and “our”), we continue to develop technological enhancements for students, families, schools and our partners. We are committed to excellence in customer service, and your privacy is important to us.

This Privacy Policy applies to Identifiable Information and Non-Identifiable Information (as both terms are defined below) collected on our website, archeredu.com (the “Site”). It also applies to other online properties that we own or manage, including campusexplorer.com, as well as any lead forms that display this Privacy Policy on third party websites (collectively, the “Services”). In addition, this Privacy Policy applies to Identifiable Information we collect on Services such as our online lead forms (“Forms”) where the Forms are made available on certain third-party websites. (Note, however, this Privacy Policy does not apply to your use of these third-party websites themselves, other than the Forms.)  A primary purpose of our Services is to, at your request, provide Identifiable Information to colleges, universities or educational marketing partners that are interested in promoting offerings to you.

We have prepared this Privacy Policy to explain what information we collect, how we collect it, for what purposes, to whom it may be disclosed, and how we protect it when you visit our Services.

This Privacy Policy is incorporated into and subject to our Terms of Use. By accessing or using the Services, you signify your assent to the terms and conditions of this Privacy Policy. If you do not agree, your only remedy is not to access or use the Services.

We may provide different or additional privacy notices in connection with certain activities, programs, and offerings. Additionally, we may provide additional “just-in-time” notices or notices at collection that may supplement or clarify our privacy practices or provide you with additional choices regarding your information.

Please note that our privacy practices are subject to the applicable laws of the regions in which we operate. Accordingly, some additional region-specific terms will only apply to individuals in those locations, or as required by applicable laws.

Identifiable Information

Archer Education will collect personally identifying information such as your name, address, email address, telephone number and similar identifying information (“Identifiable Information”), if you provide it to us through one of our sites or online services. You may verify, correct, update, or change your information at any time by emailing us at [email protected].

Our Services enable you to voluntarily provide Identifiable Information to third parties such as college or university admissions departments.

We may combine any Identifiable Information collected through the Services with other information that we obtain about you, your computer, and/or device from other companies and sources, including third-party data suppliers and public databases. Information we may collect from other sources may include name, postal address, email address and telephone number, demographic data, such as age, gender, and income level, your interests and purchase behavior; publicly-visible data, such as your posts and submissions to blogs, and other interactive forums, and other navigation data, such as web sites visited and advertisements viewed or clicked on.

Non-Identifiable Information

We automatically collect information that does not personally identify you as an individual to help us understand how our users use the Services. Like most websites, we automatically collect and use the data contained in log files. The information in the log files may include your IP (internet protocol) address, your ISP (internet service provider), the Web browser you used to visit the Services, the time you visited the Services, which Web pages you visited on the Services, and other anonymous Services usage data. We call this type of information “Non-Identifiable Information”.

Cookies and Web Beacons

We use cookies (a small file containing a string of characters that uniquely identifies your Web browser) and Web beacons (an electronic file placed within a Web site that monitors usage). We use cookies and Web beacons to improve the quality of the Services. Most Web browsers are initially set up to accept cookies, but you can reset your Web browser to refuse all cookies or to indicate when a cookie is being sent. However, certain features of the Services may not work if you delete or disable cookies.

Certain of our Service Providers (defined below) may use cookies and Web beacons in connection with the services they perform on our behalf, including, without limitation, marketing and advertising campaigns.

We use tracking pixels to collect information from users of our Services. Tracking pixels are small graphic images that allow us to understand things like whether you have viewed a page or interacted with online advertisements. We may use these technologies, including in our email communications with you, to understand your interactions with our communications and other Services.

One such provider is Google Analytics, a web analytics service provided by Google, Inc. (“Google”). Google Analytics uses cookies to help analyze how users use the Services. The information generated by these cookies about your use (including your IP address) will be transmitted to and stored by Google on servers in the United States. Google will use this information for the purpose of evaluating your use of the Services, compiling reports on activity for its staff, and providing other services relating to web page activity and internet usage. Google may also transfer this information to third parties where required to do so by law, or where such third parties process the information on Google’s behalf. You may refuse the use of cookies by selecting the appropriate settings in your browser. By using the Services and accepting cookies, you consent to the processing of data about you by Google in the manner and for the purposes set out above. Please refer to the currently available opt-outs for Google Analytics by visiting https://tools.google.com/dlpage/gaoptout/. You may obtain additional information about Google Analytics by visiting the section titled “How Google uses information from sites or apps that use our services,” located at www.google.com/policies/privacy/partners/.

TCPA Compliance

Archer Education and our affiliates will not contact you at the phone number you provide using an automatic telephone dialing system and/or an artificial or prerecorded voice unless you have provided explicit consent on a one-to-one basis between yourself and the contacting party. If you subsequently request that we not contact you at that number, we will honor your request as soon as reasonably practicable. If your contact information has already been provided to colleges, universities or such third parties acting on their behalf, our educational marketing partners, or other marketing partners, then you should specifically make a request to such parties.

You may request and receive a disclosure providing a list of categories of Identifiable Information shared, during the immediately preceding calendar year, with our marketing partners, and the names and addresses of our marketing partners with whom such information was shared. You may request such a disclosure by emailing us at [email protected].

From time to time, we might establish a business relationship with other persons or entities whom we believe trustworthy and whom we have asked to confirm that their privacy practices are consistent with ours (“Service Providers”). For example, we may contract with Service Providers to provide certain services, such as advertising, analytics tools, widget providers, data management services, Web hosting, and Web development. We provide our Service Providers with the information reasonably necessary for them to perform these services.

We may use, and disclose to third parties, certain Non-Identifiable Information regarding the Services (e.g., number of visits, page views, number of registered members who reside in a particular geographic location, etc.). However, such information does not identify you individually.

We may work with third-party marketing and advertising companies including Google LLC and Meta Platforms, Inc., which may use information about your visit to the Services in order to provide advertisements about goods and services that may be of interest to you on the Services and on third-party websites. From the Services, these companies may place or recognize a unique cookie on your computer or use other technologies such as Web beacons or pixel tags. We may use Google Analytics and their cookie to serve ads based on a user’s prior visit to the Services. Users may opt out of the cookie by visiting this page. Users may opt out of Google Analytics by visiting this page. Our Privacy Policy does not cover any use of information that a third-party advertisement serving company may collect from you.

We may share Identifiable Information and Non-Identifiable Information with entities controlling, controlled by, or under common control with Archer Education. In the event that Archer Education is merged, sold, or in the event of a transfer of some or all of our assets, we may disclose or transfer Identifiable Information and Non-Identifiable Information in connection with such transaction.

In certain instances we may disclose Identifiable Information and Non-Identifiable Information when we believe it is necessary to identify, contact, or bring legal action against persons or entities in order to protect Archer Education or our users or when we believe that the law or legal process requires such disclosure.

Interest-Based Advertising

We may ourselves, or with third-party vendors, use your information to deliver targeted advertising to you when you visit our Services or other websites. Cookies, clickstream data, and other similar technologies described above may be used in this process. For example, if you are searching for information on a particular service, we or our vendor may cause an advertisement to appear on other websites you view with information on that service. This form of advertising, sometimes called “targeted advertising,” “behavioral advertising,” or “cross-context behavioral advertising,” enables us and our vendors to know about your interests in connection with the delivery of a specific ad. We believe that such advertising is helpful because it allows you to see advertisements that are relevant to your interests. If you would like to opt out of these interest-based advertisements, please follow the opt-out process described in the section titled Your Choices below.

We may use your information to help us, or our third-party vendors, determine if you have interacted with our Services across multiple devices and to match such devices. To accomplish this, we may rely on information (including demographic, geographic and interest-based data) from third parties such as data vendors, pursuant to their own privacy policies, or we may use information we collect in conjunction with such third-party data. Based on this data, we may then display targeted advertisements across devices that we believe are associated with each other, and may further provide services to our advertisers to better enable cross-device targeting and analysis. To opt-out of or restrict our use of certain cross-device data, please see the section titled Your Choices below.

Links to Other Sites and Social Media Services

We may create links to other websites that we think may be of interest to you, such as providers of various products and services. We may also provide links that allow you to send or forward a post from our Services through or to third-party social media sites, or other means of electronic communication, such as an email or text messaging service.

We do not endorse any other websites, providers, or services by providing such links, and this Privacy Policy applies only to your use of our Services. We are not responsible for the privacy policies of any websites and services we link to on our Services, and you should read the privacy policies of each site you visit to determine what data that site may collect about you.

The Services may also integrate with social media services. We do not control such services and are not liable for the manner in which they operate. While we may provide you with the ability to use such services in connection with our Services, we are doing so merely as an accommodation and, like you, are relying upon those third-party services to operate properly and fairly.

You should be aware that any Identifiable Information which you voluntarily include and transmit online in a publicly accessible blog, forum, social network, or otherwise may be viewed and used by others. By using such features, you assume the risk that the Identifiable Information provided by you may be viewed and used by third parties.

Data Retention

We will retain your Identifiable Information for as long as your inquiry is active or as needed to provide you with the Services, and for a reasonable time thereafter in accordance with our standard procedures or as necessary to comply with our legal obligations, to resolve disputes, and to enforce our agreements. Even if we delete some or all of your information, we may continue to retain and use anonymous or aggregate data, or any other data that constitutes Non-Identifiable Information.
